Gary Kaplan is a partner at Farella Braun + Martel and Chairs the firm's Restructuring, Insolvency & Creditors Rights Group, which has earned national and San Francisco rankings from U.S. News - Best Lawyers.
Mr. Kaplan represents debtors, secured and unsecured creditors, creditors' committees, trustees and receivers in a wide range of bankruptcy and non-bankruptcy matters. His practice includes both out of court and Chapter 11 restructurings, including advising clients regarding pre- and post-bankruptcy strategy, debt collection, judgment enforcement and provisional remedies. He has represented both lenders and borrowers in a wide range of financing transactions, including debtor-in-possession financing, as well as lease and guaranty issues. He also has extensive litigation experience in both bankruptcy and non-bankruptcy courts, at trial and appellate levels, including in the U.S. Supreme Court.
Among other high-profile representations, Mr. Kaplan has recently acted as lead counsel for Yellow Cab Cooperative in its Chapter 11 bankruptcy case, and was co-lead counsel for Pacific Gas and Electric Company and Pacific Lumber Company in each of their Chapter 11 bankruptcy cases, which were among the largest bankruptcy cases ever filed in their respective industries, and resulted in those companies' successful reorganizations. He also has represented the Official Unsecured Creditors’ Committees in each of the Carey Limousine L.A. and Cascade Acceptance Corporation Chapter 11 cases. In addition, he has extensive experience in receivership matters, including represented the receivers for each of the Ritz Carlton Hotel and the Northstar Lodge in the Lake Tahoe area.
Mr. Kaplan is Board Certified in Business Bankruptcy Law by the American Board of Certification and a Certified Legal Specialist in Bankruptcy Law by the State Bar of California. He is past president of the Bay Area Bankruptcy Forum, past chair of the California State Bar Bankruptcy Law Advisory Commission and has served by appointment on the California State Bar Insolvency Law Committee.
Mr. Kaplan has lectured and written on a variety of bankruptcy and commercial law topics. He has been named among the Northern California Super Lawyers (2004-2006, 2009-2016) and has repeatedly been selected as one of a handful of "recommended" attorneys in the San Francisco Bay Area by PLC’s The Restructuring and Insolvency Handbook. Mr. Kaplan was named Corporate LiveWire Lawyer of the Year for 2014 in the category Bankruptcy & Restructuring - San Francisco, the firm received Corporate LiveWire Global Awards in 2015 and 2016 in the same category and the restructuring & insolvency practice group won Insolvency Law Firm of the Year in 2017. He is a ten-time recipient of the "Outstanding Volunteer in Public Service" award from the Bar Association of San Francisco and has received a Certificate of Recognition as an "Outstanding Volunteer in Public Service" from the California State Senate based on his consumer bankruptcy work.
Prior to his legal career, Mr. Kaplan was a Financial Analyst with First Boston Corporation (now Credit Suisse).
