This session will discuss new and challenging topics that are likely to impact practitioners in the fields of Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA or Superfund), Resource Conservation and Recovery Act (RCRA), and related areas. The panel will highlight recent regulatory developments under RCRA including the coal combustion rules, e-manifest rules, carbon capture and sequestration rules, and regulating hazardous waste in the retail sector.

Moving on to CERCLA, the panel will discuss the processes, problems, and opportunities that arise from pre-ROD settlement of Natural Resource Damages claims, highlights of the first-of-its-kind Environmental Justice review of a CERCLA proposed cleanup plan, and a new spin on approaching proportional liability among PRPs.
