As an employment and business litigator, James Baker represents a wide variety of large and small companies in the technology, online retailing, manufacturing, and delivery industries.
Mr. Baker’s experience includes advising employers in single-plaintiff and class action disputes in both state and federal courts that involve age, gender and other discrimination claims, wage and hour compliance, and workplace policies. He also counsels clients on constantly evolving employment law issues including arbitration clauses, medical leave, and employee-contractor classification.
In handling business litigation, Mr. Baker usually serves as the sole associate drafting motions and briefs, managing discovery, and conducting research. He has experience representing large construction suppliers in product liability cases, and he was the second chair in a recent successful arbitration in a breach of contract dispute that resulted in a nearly $400,000 award.
Mr. Baker maintains an active pro bono practice, recently serving on a team representing a Bay Area city against several Second Amendment challenges to its passed ballot initiative.
