Tyler Gerking practices civil litigation with a focus on insurance coverage. Mr. Gerking has litigated a wide variety of commercial disputes for individuals, private companies and public corporations in state and federal courts, as well as in alternative dispute resolution settings. He has handled matters involving issues of insurance coverage, bankruptcy, contract, commercial real estate, and intellectual property. In his insurance coverage practice, Mr. Gerking has assisted a number of insurance policyholders in securing coverage under commercial general liability, directors' and officers' liability, professional errors and omissions liability, employment practices liability and first-party property policies.
Mr. Gerking won summary judgment in U.S. District Court for a general contractor of a complex construction project against its insurer for breach of the duty to defend. He has advised several clients, including a nationwide retailer, on a variety of insurance and insolvency issues arising out of the potential insolvency of Kemper Insurance Companies. He has pursued and obtained directors' and officers' liability insurance recoveries on behalf of several clients in connection with stock option backdating litigation. In U.S. Bankruptcy Court, Mr. Gerking has defended clients against claims for preferential and fraudulent transfers, as well as a heavily litigated civil contempt proceeding involving a dispute over commercial real estate in Poland.
Mr. Gerking has represented, among others, McAfee, Inc., McKesson Corp., Novartis Vaccines & Diagnostics, Central Garden & Pet Co., Centillium Communications, Inc., as well as the shareholder derivative plaintiffs in the Broadcom Corp. stock options backdating litigation.
He was a judicial extern for Magistrate Judge Maria-Elena James of the U.S. District Court for the Northern District of California in San Francisco. Mr. Gerking is proficient in German and Spanish, and conversant in Farsi-Dari.
