John L. Cooper maintains a diverse trial practice in intellectual property, antitrust and commercial litigation. His practice emphasizes technology-related litigation, and he is the senior member of the firm’s Intellectual Property Litigation Group.
Mr. Cooper regularly represents technology companies in patent and other intellectual property litigation as well as in antitrust and technological defect litigation and disputes. He serves as primary outside counsel on litigation and business matters to several technology companies on intellectual property, antitrust and commercial issues relating to technology. He has recently won summary judgments of non-infringement in Dolby v. Lucent, PostX v. Secure Data In Motion and Drexler v. Dolby.
Mr. Cooper’s litigation practice includes representation of such companies as Smiths Group PLC, Dolby Laboratories, Inc., Atmel Corporation and Sigaba Corporation, defending and prosecuting major and protracted patent litigation. He represented the UK-based Bass PLC and Holiday Inns in litigation arising out of Bass PLC’s $2.3 billion acquisition of Holiday Inns in 1990 as well as in litigation related to Bass PLC’s acquisition of Inter-Continental Hotels. Mr. Cooper was co-lead counsel in a suit against three of the nation’s largest plywood manufacturers, and obtained an antitrust judgment for approximately $2 billion. On appeal, he won the argument against the former Solicitor General Robert Bork. Mr. Cooper headed the trial team defending the Wm. E. Pollock Company, one of seven securities dealers sued in a $70 million action brought by the City of San Jose. He has defended securities and antitrust actions in both federal and state courts and was appointed by Judge Motz to serve as Special Master in the Microsoft Antitrust litigation.
Mr. Cooper has received industry and peer recognition throughout his 32 year career. He was selected as one of the Top 30 Intellectual Property Lawyers in California by the Daily Journal, named by Chambers USA as a leading intellectual property lawyer in California, and has been selected for inclusion in The Best Lawyers in America for over 10 years and in Northern California Super Lawyers. Mr. Cooper is a Fellow and former Regent of the American College of Trial Lawyers.
He is regularly asked to conduct lectures and presentations, by legal and industry associations and governing bodies. He was co-editor of "Anatomy of a Patent Case" published by the Federal Judicial Center in 2009. He has recently spoken to the American Bar Association, The Ninth Circuit Judicial Conference and the Intellectual Property Commissioners for the European Economic Community. He is also well published and tapped by the media for comment on intellectual property and technology litigation stories. His paper, "Balancing of Competitor Cooperation" was published by the Antitrust Law Journal.
