David J. Lazerwitz, Partner

David J. Lazerwitz is a partner in the Environmental Law Department where he represents and counsels public and private clients in environmental and natural resources compliance, permitting and litigation matters.

Mr. Lazerwitz regularly represents and advises a broad range of clients, including pharmaceutical, renewable energy, water services, winery and manufacturing firms, in regulatory and permitting matters before federal, state and local agencies.  His compliance practice focuses on water quality, wetlands, environmental impact analysis, hazardous waste and federal public lands issues and includes advising clients in permitting and compliance issues and responding to agency inspections and administrative enforcement actions.  Mr. Lazerwitz has extensive experience in counseling clients in all aspects of project and site development from orchestrating overall permitting strategies to securing individual permits and approvals. 

Mr. Lazerwitz possesses significant federal and state court litigation experience, including more than a dozen federal appellate arguments in environmental cases.  His litigation practice includes representing clients in federal and state court and administrative proceedings in actions arising under the Clean Water Act, CERCLA, NEPA, CEQA and other federal and state environmental and natural resources laws.  He has extensive experience in defending citizen suit actions brought pursuant to federal law. In his current practice and as a former attorney with the U.S. Department of Justice's Environment and Natural Resources Division, Mr. Lazerwitz also possesses substantial experience in negotiating and resolving multi-party lawsuits involving the U.S. Environmental Protection Agency, Bureau of Land Management, U.S. Fish and Wildlife Service, NOAA Fisheries, U.S. Army Corps of Engineers, state agencies and public interest organizations.  

Mr. Lazerwitz has published numerous articles on environmental and natural resources law.  In 2010, he received a California Lawyer Attorneys of the Year (CLAY) award for his pro bono efforts to secure a federal ruling protecting California deserts from off-highway vehicle impacts.

He is admitted to practice before the United States Supreme Court; United States Courts of Appeals for the First, Fourth, Fifth, Sixth, Ninth, Tenth, Federal and D.C. Circuits; United States District Courts for the Northern and Eastern District of California and Colorado.
