Nan E. Joesten, Partner
Nan E. Joesten is a partner in both the firm's Intellectual Property and Business Litigation groups. Her diverse complex litigation practice focuses on a wide variety of commercial disputes, including patent and trademark infringement, trade secret misappropriation, and technology-related litigation.
Ms. Joesten's patent experience includes representing Trimble Navigation Limited in asserting its patent for last pass GPS-guidance in an agriculture application against accused infringers. She defended the Chiron Corporation in a patent trial involving a drug-device combination patent. She regularly represents Dolby Laboratories, and won summary judgment of noninfringement in a patent case regarding Dolby's digital audio technology.
Ms. Joesten's practice is varied in response to her clients' business needs. She successfully represented the non-pilot retirees through the creation of a Section 1114 Committee in the Delta Air Lines bankruptcy. She also prevailed in a motion to strike a wide range of contract and tort claims against Novartis Pharmaceutical Company using California's anti-SLAPP (strategic lawsuit against public participation) statute, where the case settled after the plaintiffs' claims were dismissed in their entirety and Novartis was awarded attorneys fees, without any discovery being taken.
Ms. Joesten is experienced in litigation involving non-U.S. parties. She represented Japanese semiconductor equipment manufacturer Dainippon Screen Manufacturing Company in protracted patent litigation culminating in a month-long jury trial. She represents HannSpree North America, Inc., the U.S. subsidiary of Taiwanese-based HannSpree, Inc., in litigation regarding HannSpree's high-end LCD panels.
Prior to her legal career, Ms. Joesten was a manufacturing engineer and an advertising brand manager for the Procter & Gamble Company. Ms. Joesten is chair of the board of directors of the Boalt Hall Alumni Association, and was awarded the UC Berkeley Foundation 2007 Trustee's Citation Award for outstanding service to the law school. She is also a co-chair of the Woman Advocate Committee of the ABA's Litigation Section. At Farella, she is the partner co-chair of the firm's Professional Development Committee, and has written and spoken on the importance of mentoring in the legal profession.
