Andrew Leibnitz maintains a diverse trial practice in the fields of intellectual property and complex commercial litigation. He litigates in state, federal, and administrative proceedings nationally in the fields of patents, trademarks, copyrights, trade secrets, antitrust, unfair competition, licenses and commercial contracts.
Recently, Mr. Leibnitz obtained appellate affirmance of summary judgment in favor of Dolby Laboratories in a patent infringement dispute against Lucent Technologies. Where Lucent relied upon the same patent to sue Microsoft - obtaining the largest patent verdict in history ($1.52 billion) - Dolby nonetheless prevailed. Indeed, Mr. Leibnitz recovered attorneys' fees from Lucent in favor of his client.
Mr. Leibnitz also recently obtained an arbitral award of over $43 million in a trade secret misappropriation case on behalf of a Silicon Valley semiconductor manufacturer against Swedish telecommunications conglomerate, LM Ericsson.
Mr. Leibnitz has assisted companies in a variety of industries, including retail, banking, energy / power, manufacturing, leasing, construction, and importing. In the high technology realm, he has represented businesses in such fields as audio "surround sound" technology, ophthalmic ("laser eye") surgery, internet security, disk drive manufacturing, semiconductor fabrication, spinal implant research, and voicemail messaging.
Mr. Leibnitz has been recognized as a top attorney by Law & Politics Magazine in its list of Northern California "Super Lawyers" each year since the inception of the list in 2004.
Prior to joining Farella Braun + Martel, Mr. Leibnitz served as a law clerk to the Honorable Martin J. Jenkins of the United States District Court in San Francisco.
