Farella Braun + Martel offers a full range of legal services relating to the development, construction and operation of power generation facilities.  Our Construction Counseling & Dispute Resolution Group represents owners, developers, EPC contractors, and design professionals on issues of contract interpretation, warranty provisions and in a wide variety of disputes arising out of the design, construction and operation of power plants. 

Our construction attorneys have counseled and represented clients on regional, national and international power plant projects ranging from nuclear and co-generation plants to transmission, gas, coal, hydroelectric and process plants to waste-to-energy and other bio-mass fired plants.  The value of the claims asserted in connection with some of these projects has ranged from $65 million to $200 million to upwards of $2 billion.

Our Environmental Group also provides a substantial environmental, health & safety (EH&S) and pipeline safety practice that serves the needs of our energy clients.  This practice includes due diligence assessments, permitting and licensing, regulatory compliance, contaminated site investigation and remediation, and administrative and criminal enforcement actions.

Farella Braun + Martel's expertise includes the additional legal issues that arise in connection with energy and utility projects.  Our attorneys have represented parties in connection with the enforcement of direct access electrical power agreements.  In connection with a bio-mass plant in California, we represented a plant owner concerning an OSHA investigation into a wrongful death claim and a rate dispute with the local investor-owned utility.  We also are representing the California Independent System Operator (Cal ISO) in all of its litigation and arbitration concerning tariff, regulatory and contract matters.
