Farella Braun + Martel is at the forefront of the rapidly developing market and regulatory environment for alternative and renewable energy and clean technology.  We offer sophisticated strategic counseling and business advice to alternative and renewable energy project developers, manufacturers, independent power producers and entities which purchase and use clean technologies.

Our multi-disciplinary team of attorneys provides clients a range of services including corporate structuring and financing, mergers and acquisitions, project and project asset sales and financings, joint development agreements, contract negotiation, environmental counseling and permitting, real estate transactions, employment counseling , tax counseling, intellectual property and judicial and administrative agency litigation.  For example, we represent vertically integrated solar energy companies in the acquisition and sale of photovoltaic projects and project assets, joint development agreements, real estate acquisitions, environmental and land use permitting, and engineering, procurement and construction agreements.  Some of our clients have business lines that include the design and manufacturing of photovoltaic modules and the development, construction and operation of large-scale photovoltaic solar farms.

In addition to solar farms and rooftop installations, we have experience with corporate structuring and financing of biodiesel production facilities and equipment, methane gas production at landfills, and wind farm facilities.  Our corporate team assists green technology start-ups with angel and series A round funding and project development and technology production facilities with financing through raising equity, debt offerings, multi-stage auctions and leveraging federal and state tax credits.  We have also assisted clients respond to and comply with requests pursuant to the Freedom of Information Act (FOIA).

We advise national and international EPC contractors in connection with the design and development of alternative energy production facilities.  We have negotiated leases for power purchasers and land owners, module and stock supply agreements and various construction, real estate, permitting and mitigation contracts and permits.  Farella is unique in being able to provide advice and representation in a wide range of aspects of energy projects, from  facility development through the power purchase agreements and reverse metering structures.  We have assisted our clients at every stage of development for both distributed and utility scale projects in California, Hawaii, Florida and Western Canada.
