Aviva Gilbert represents both companies and individuals in interactions with regulatory and criminal justice systems at the state and federal levels. She helps companies address compliance issues in data protection and healthcare regulation, and shepherds clients through all stages of regulatory and criminal cases. Ms. Gilbert also helps conduct internal investigations into securities issues and other concerns within a company. Her clients have included corporations in a wide variety of industries, such as technology and healthcare and large nonprofit organizations.

Ms. Gilbert also maintains a data privacy and cybersecurity practice, assisting clients with cyberbreach incident response planning and data protection guidelines, and consulting on privacy issues to manage risk and compliance with governing law.

Some of Ms. Gilbert’s most recent experience includes:

  • Representing an individual defendant in parallel federal and state investigations into improper public/private-sector dealings
  • Evaluating and consulting on a client’s data privacy and security policies in anticipation of business growth and expansion
  • Conducting an internal investigation for a large organization involving alleged employee theft
  • Representing an individual in a federal investigation into the data behind a medical diagnostic test

Ms. Gilbert also maintains an active pro bono practice, including defending clients in eviction proceedings and pursing mandamus for a client wronged by a state agency.

Before joining Farella, Ms. Gilbert clerked for the Hon. Wilma A. Lewis, Chief Judge of the U.S. District Court for the Virgin Islands. She was also a Fulbright Fellow from 2007-2008, working at Mexico’s National Institute of Public Health. Prior to becoming a lawyer she was an Associate in the Global Communications and Public Affairs division of Google where she worked on government and education sector issues.
