Represent PV Hardware in pre-litigation dispute and mediation process concerning damage to solar power plant following wind storm.

NaturEner USA

Represent NaturEner USA, a US subsidiary of a Spanish company, concerning two utility size wind farms it has developed in Montana, each having approximately 70 wind turbine generators (“WTGs”).  A significant number of the WTGs appear to have gears that are suffering fatigue failure.

Tetra Tech Desalination Plant Project

Represented Tetra Tech in connection with the negotiation of an EPC contract for the design and construction of a desalination plant in Huntington Beach, California. Tetra Tech is a leading provider of consulting, engineering, program management, construction, and technical services addressing the resource management and infrastructure markets worldwide.

SOLON Corporation

Represented manufacturer/developer in connection with EPC, O&M and stock purchase agreements related to 10 megawatt tracking solar energy facility in Mohave County, AZ.

San Francisco Bay Bridge's Temporary Bypass Structure

We represented the designer, an engineering and consulting firm, of the San Francisco Bay Bridge Temporary Bypass Structure in disputes with Caltrans and the design-build contractor valued at more than $20 million.

Exploratorium Museum San Francisco

Assisted in monetizing the renewable energy tax credits associated with an approx. $7 million 1.5 MW PV rooftop solar installation at its newly renovated science museum facility located on the San Francisco waterfront and represented the client in connection with agreements for the purchase and operation and maintenance of the system.

California Almond Growers Exchange

Represented an EPC contractor in connection with a dispute over the performance of a bio-mass fired cogeneration power plant located in the Sacramento area and operated by the California Almond Growers Exchange.

Catholic Healthcare West Co-Generation Projects

Represented EPC contractor in disputes with project owner concerning performance and delay claims involving several co-generation facilities.

Gas-to-Energy Co-Generation Facility at San Bernardino Wastewater Treatment Plant

Represented an EPC contractor in disputes with the project owner over performance and delay claims stemming from biogas quantity and quality issues.

Imperial Valley Waste to Energy Plant

Represented the EPC contractor in a dispute concerning the performance of the fuel handling and combustion systems of this Waste to Energy Plant in the Imperial Valley of California.

PV Solar Agreements - Arizona

We have represented a variety of owners and developers in connection with the negotiation and documentation of agreements related to the engineering, procurement, construction, and purchase and sale of photovoltaic electricity generation facilities, including a 20 MW tracking ground-mounted system in Arizona.
