Antitrust and Managed Care Contracting
In October 2019, Sutter Health agreed to injunctive relief and to pay $575 million to settle claims brought by the California Attorney General as well as a class of self-funded payors, including unions and employers, regarding allegedly anticompetitive contracting practices. Related private litigation in federal court is still ongoing. This presentation will explore the legal issues that arise from managed care contracting, including liability under the Cartwright Act and Unfair Competition Law and other issues litigated in the Sutter Health cases.
