This session will discuss new and challenging topics that are likely to impact practitioners in the fields of CERCLA, RCRA, and related areas. Subjects include a review of potential significant legal changes presented by EPA’s RCRA rulemaking activity and a look at the emerging legal issues associated with e-wastes. Moving on to CERCLA, the panel will discuss the processes, problems, and opportunities that arise from pre-ROD settlement of NRD claims, highlights of the first-of-its-kind Environmental Justice review of a CERCLA proposed cleanup plan, a new spin on approaching approportional liability among PRPs, and a review of state law approaches for allocating remedial costs.
