Outside litigation funding continues to grow in importance and complexity. This program reviews the mechanics of litigation funding and the special challenges it can raise for arbitrators and mediators. It raises significant issues for neutrals, principally around the pros and cons of disclosure of the existence of litigation funding and the identity of the funder. The practice and rules differ. Some claimants who have litigation funding may proclaim it; others may keep it secret. Neutrals must be aware of and understand the issues and implications of litigation funding.
