What’s Happening With PFAS Regulation?

May 20, 2025
Colorado Bar Association

Sarah Bell is speaking on PFAS regulation at the Colorado Bar Association Environmental CLE virtual program "What’s Happening With PFAS Regulation?"

This program will address the status of key federal regulatory initiatives under the Safe Drinking Water Act, CERCLA, and RCRA to regulate PFAS contaminant levels in the environment, particularly in public water supplies, and to explicitly extend federal cleanup authorities to PFAS. If these regulations go into effect, they will have widespread and costly impacts for public water supply systems, cleanup of newly identified sites, sites where investigation and remediation are already underway, as well as “closed” sites where the presence or potential presence of PFAS contamination could lead to reopeners. The presenters will discuss these considerations and will also address what is likely to happen if the various recently proposed PFAS rules are withdrawn, remanded, or struck down.

Finally, the program will also address key PFAS-related legislative and regulatory initiatives in Colorado and explore where additional state-level action is likely in the near term, given developments at the federal level.
