"3 Things Lawyers Should Know About Chapter 11 Real Estate"

Gary Kaplan, chair of Farella's Restructuring & Insolvency practice, spoke to Law360 about some of the unique challenges retailers face in bankruptcy proceedings.

But whether liquidating or reorganizing, all such cases “have a real estate play," Mr. Kaplan told Law360. "You have to recognize that this is not the typical case ... of creditors and debtors," Mr. Kaplan said. "In retail mode, you have to figure out quickly which leases and stores have value. Sometimes the debtor owns the store."

"The real question is: 'Is there value in those leases?'" he added.
