Farella Braun + Martel Wins $43.1 Million Breach of Contract and Misappropriation of Trade Secrets Decision for Atmel Corporation

December 7, 2005 Announcement

SAN FRANCISCO, CA (December 7, 2005): Farella Braun + Martel LLP announced today that a team led by partner John Cooper won a substantial award in an arbitration on behalf of Atmel Corporation, a worldwide leader in the development, fabrication, and sale of advanced semiconductors.

The International Arbitration Tribunal for the International Centre for Dispute Resolution awarded Atmel approximately $43.1 million in damages, finding LM Ericsson Telefon, AB liable for numerous breaches of contract as well as the misappropriation of trade secrets relating to Atmel’s proprietary AVR microcontroller technology.

As part of the decision, the Arbitration Panel also awarded Atmel an immediate injunction against Ericsson and those “acting in concert or participation with it,” including Sony Ericsson and Texas Instruments.

Farella Braun + Martel partner John Cooper led the team which presented the case to the Arbitration Panel in New York City.  Other Farella Braun + Martel attorneys involved in achieving the award for Atmel included partners Andrew Leibnitz, Grace Won, and associate Anthony Schoenberg. The firm’s legal team worked closely with Atmel Senior Litigation Counsel, Cynthia Bright.
