Farella Provides Amicus Support in Case Challenging Denial of CARES Act Funds to Incarcerated Individuals and Their Families

SAN FRANCISCO, August 31, 2020: Farella Braun + Martel, along with co-counsel the American Civil Liberties Union Foundation of Northern California, filed an amici curiae brief in support of the plaintiffs’ motion for a preliminary injunction in Scholl et al. v. Mnuchin et al., in which plaintiffs are seeking to stop the federal government from denying CARES Act Economic Incentive Payments to incarcerated and recently incarcerated individuals. 

The amici curiae brief was filed on behalf of a broad group of over twenty organizations that represent or provide services to incarcerated people, previously incarcerated people, and their families, including the East Bay Community Law Center. 

In the brief, amici curiae sought to provide the court with empirical data regarding the impact of defendants’ denial of CARES Act funds to incarcerated people, as well as those newly released who are grappling with re-entry amid a pandemic that has decimated California’s economy

Scholl et al. v. Mnuchin et al. is currently pending in the U.S. District Court for the Northern District of California.
