California Cases to Watch in 2020

Jessica Nall was quoted in the article "California Cases to Watch in 2020" in Law360.  Jessica commented on two high-profile criminal cases against former technology executives pending in the Northern District of California, the Theranos and Levandowski cases.

In the article, she noted that the Theranos and Levandowski criminal cases both came out of civil litigation and they will likely serve as a test for prosecutors and U.S. Attorney David L. Anderson of the Northern District of California.

She also noted that the the Levandowski case is one of only a few pending trade secret indictments involving domestic companies, which is significant, she said, because until recently the U.S. attorney's office had indicated that the government was primarily targeting international trade secret theft involving China.

Additionally, Jessica said the Levandowski case, together with a trade secret theft case against former Jawbone employees, will test the government's theory of intellectual property theft and what constitutes a trade secret. "Is the government really pushing the envelope? Are these really trade secrets or is there some other explanation for the conduct?" she said.
