"Coverage For Construction Fixes In California Remains Murky"

Farella Insurance Coverage Partner Erica Villanueva commented on the impact of the Regional Steel Corp. v. Liberty Surplus Insurance Corp. decision by a California appeals court. According to Villanueva, the decision raises more questions than it answers.

"In practice, it's difficult to draw that line," Villanueva said in the article. "Regional Steel attempted to harmonize all those decisions and argued that there isn't a conflict, but I think that this could end up being something that the California Supreme Court could have to resolve." Villanueva said the products at issue were defective seismic tie hooks that could have made the building dangerous if an earthquake struck — a scenario that she argued was functionally no different from the danger posed by asbestos-containing materials in a building.
