Nevada Links Wins Summary Judgment Motion in Case Brought by United States

Successfully defended client against a $100 million lawsuit brought by the United States alleging that a land lease between Nevada Links and Clark County violated the Southern Nevada Public Land Management Act administered by the Bureau of Land Management.  Following more than three years of litigation, the U.S District Court District of Nevada granted Nevada Links’ summary judgment motion, agreeing with the Farella team’s position that the statute of limitations had expired before the United States filed suit.

Webcor-Obayashi Joint Venture v. Zurich American Insurance Company

Represent Webcor-Obayashi Joint Venture, the general contractor for the Salesforce Transit Center, against its builder’s risk insurer, Zurich American Insurance Company.  

Murieta Inn and Day Spa

Representing the owner of the Murieta Inn and Spa in Rancho Murieta, California in connection with delay and other claims arising out of the design and construction of the Inn.

Real Estate Developer Representation

Represented real estate developer through four week jury trial in San Francisco Superior Court, involving claims of rescission, breach of contract, and fraud.

Single Thread Farms

Represented ST Hospitality Group, the owner and developer of Single Thread Farms, a luxury restaurant and boutique hotel, in connection with construction cost and delay claims arising out of the extensive remodel and build out of Single Thread Farm’s facilities in Healdsburg, California.

Concar Offices -- Real Estate Litigation

We were retained by the developer of this 200,000 square foot office complex in the City of San Mateo to defend it against easement claims made by the owner of an adjacent and competing office complex that threatened to substantially limit ingress and egress to the property.

Constant Vineyards

We defended Constant Vineyards, a producer of luxury class cabernet sauvignon on Diamond Mountain in Napa, against claims by a neighboring landowner that it was entitled to several prescriptive easements across Constant Vineyards' property.

Foundry Square -- Project Development

Located in San Francisco’s South of Market area, Foundry Square is a state of the art four-building project.  We worked on virtually every aspect of this project, from the formation of the ownership entities, the conceptualization and negotiation of complex purchase, joint venture, ground lease and operating agreements in connection with the acquisition of the underlying land, and the drafting and negotiation of construction, architectural and other design professional contracts.

Foundry Square -- Real Estate Litigation

We provided pre-litigation counseling and assisted the developer of this major mixed-use complex in San Francisco's South of Market area in resolving a dispute concerning one of its key property acquisition agreements.

Golden Gateway Center – Apartment Complex Projects

Assisted Golden Gateway Center in drafting contracts for the repair of its apartment facilities in San Francisco, as well as for updating its fire control systems.  Represented Golden Gateway Center in connection with various faulty workmanship claims.

Hodge v. Franklin; Vigneau v. Franklin

Represented the directors of a publicly traded Real Estate Investment Trust in companion state court class actions alleging violations of securities laws and related statutes.
