District Court Issues Preliminary Injunction Prohibiting Enforcement of Oregon’s Packaging EPR Law

On February 6, 2026, the Oregon District Court issued a preliminary injunction prohibiting enforcement of Oregon’s Plastic Pollution and Recycling Modernization Act, which is Oregon’s extended producer responsibility law that applies to packaging, printing and writing paper, and food serviceware.

In its brief order, the court found that “[s]erious questions go to the merits of Plaintiff’s claims, there is a likelihood of irreparable injury, and the balance of hardships tips sharply in favor of Plaintiff,” and thus issued a preliminary injunction prohibiting Oregon from “enforcing the Plastic Pollution and Recycling Modernization Act against Plaintiff National Association of Wholesale Distributors and its members.”
