Maine Passes First-In-The-Nation EPR Law Targeting Electronic Smoking Devices
On April 23, 2026, Maine became the first state in the nation to pass an extended producer responsibility (EPR) law targeting vapes, e-cigarettes, and other electronic smoking devices.
Pursuant to LD 1519, producers are required to implement and finance a stewardship program, and must submit a stewardship plan to Maine’s Department of Environmental Protection by November 1, 2027. After approval of a stewardship plan, producers will have 180 days to participate in a stewardship program in order to continue selling electronic smoking devices in Maine, and retailers in Maine will have 3 years to begin participating in the stewardship program as collection locations.
