Amicus Brief in The Episcopal Church in the Diocese of California, et al. v. Episcopal Senior Communities, et al.
On Behalf of the Friends of the Episcopal Diocese, an unincorporated association of residents served by Episcopal Senior Communities, we submitted an Amicus Brief to the First District of California Court of Appeals. The Amicus sought to reverse the trial court’s judgment because the trial court improperly interpreted and applied the charitable trust doctrine. Our brief explains how, If upheld, the trial court’s erroneous judgement would set precedent for the incorrect application of the Charitable Trust Doctrine, contrary to well-settled law in this state, and would negatively affect nonprofit public benefit corporations state-wide.
