Farella Braun + Martel Assists Zep Solar Settle Patent Infringement Suit Against Westinghouse Solar

SAN FRANCISCO, May 31, 2012:  Farella Braun + Martel announced today that its client Zep Solar has reached a confidential settlement in its multi-year patent infringement dispute with Westinghouse Solar.

Farella represented Zep Solar in patent infringement proceedings in the Northern District of California and the International Trade Commission.  After assisting Zep Solar to obtain an early dismissal of Plaintiffs' claim for declaratory judgment for a lack of subject matter jurisdiction, Farella then assisted Zep Solar in obtaining a stay of district court litigations between the parties pending inter partes reexaminations of the patent-in-suit in the Patent and Trademark Office.  Farella also represented Zep Solar in its affirmative patent infringement action against Westinghouse.

Pursuant to the settlement, the parties will seek termination and dismissal of all pending proceedings in District Court and the United States International Trade Commission
