"Micron Ruling May Spark New Wave of Venue Fights"

IP litigator Jim Day commented on the Federal Circuit's decision that TC Heartland was a change in the law.

Commenting on the statement in the article that the biggest winners from the ruling are companies that have lost venue arguments in courts where it was decided the Supreme Court's TC Heartland ruling was not a change, Mr. Day said he wouldn’t be surprised to see a flurry of motions asking judges to reconsider those types of decisions. “It seems that if it was worth making a motion to change venue three months ago, in a lot of those cases it’s going to be worth refiling it,” he said. “I would expect the short-term impact to be a bunch of refiled venue motions.”
