CalRecycle Holds September 2026 Informal Regulatory Concepts Workshop on California’s Textile EPR Law
On September 29, 2026, CalRecycle held another in a series of Textile Stewardship Informal Regulatory Concepts Workshops to solicit feedback on regulatory concepts for implementing SB 707.
SB 707, the Responsible Textile Recovery Act of 2024, is California’s extended producer responsibility (EPR) law specific to apparel and textiles. Under SB 707, “covered products” are broadly defined and encompass a wide variety of apparel and textile items – such as shirts and dresses, leisurewear and athletic wear, formal wear, everyday uniforms for workwear, handbags, knitted and woven accessories, bedding, tablecloths, fabric window coverings, and pillows – and it will have significant implications for entities throughout the supply chain.
The September Workshop included discussion of a number of proposed regulatory concepts, including:
- Establishing a uniform registration process, whereby the PRO would be responsible for a process to map a regulated entity within the producer hierarchy and that may include a registration portal and assignment of a producer registration number;
- Clarifying that an entity may be considered a producer for selling “in or into the state” because, for example, the entity is subject to the jurisdiction of California courts and/or voluntarily assumed responsibility under the statute;
- Specifying that certain entities may assume some or all of the duties and liabilities of a producer by, for example, using a standardized duty agreement that the PRO may be required to include in its producer responsibility plan or by otherwise submitting a duty assumption agreement to the PRO that includes specified information;
- Specifying the process by which an entity would establish the small seller exemption (which applies to sellers with less than $1M in annual aggregate global turnover) that may include, for example, standardized forms and/or an annual renewal requirement; and
- Because a producer does not include a seller of only secondhand covered products, clarifying when a product will be considered a secondhand product and specifying how it may be acquired (e.g., only when sold by a secondhand market).
