Federal Court Enjoins the California AG From Enforcing SB 343

July 15, 2026 Perspectives

On July 14, 2026, the U.S. District Court for the Southern District of California issued a preliminary injunction prohibiting the California Attorney General (AG) and those in privity or acting in concert with the AG from enforcing California’s SB 343 until further order of the court.  The court's order was based largely on a finding that the plaintiffs had established a likelihood of success on the merits in the ongoing litigation.

As a reminder, for products and packaging manufactured after Sunday, October 4, 2026, SB 343 would prohibit use of the chasing arrows symbol or other indications of recyclability on products or packaging that do not meet certain criteria.

The order filed in California League of Food Producers, et al. v. Bonta, 3:26-cv-01675-WQH-JAC (S.D. Cal.) is available here.
