Before the Government Comes Calling…Conducting Strategic Internal Investigations to Identify and Address Corporate Malfeasance

November 6, 2020
Association of Corporate Counsel

Aviva Gilbert will moderate and William Keane is a panelist for ACC's live webinar, "Before the Government Comes Calling…Conducting Strategic Internal Investigations to Identify and Address Corporate Malfeasance."

Details:
No corporate counsel wants to hear first about alleged misconduct at their company from one of the alphabet soup of government agencies (DOJ, SEC, CFTC, AG) or regulators. The corporation will be much better off identifying and investigating malfeasance before the government comes calling. Establishing strong investigatory procedures can help root out—and explain, if needed—any misconduct occurring in backrooms, executive suites and on sales teams. Good corporate hygiene combined with focused, efficient internal investigations can help mitigate liability and related financial penalties, along with potential reputation harm, and also protect from costly litigation. This panel will cover best practices for companies and their counsel in conducting internal investigations, including those overseen by the board of directors. The panelists will also discuss challenging issues they have encountered, including recommendations for education and training for in-house counsel.

This CLE program presented by experienced white-collar defense and investigations lawyers and a general counsel will leverage the newly released American College of Trial Lawyers’ white paper: A 2020 Update:  Recommended Practices For Companies And Their Counsel In Conducting Internal Investigations.

Moderator:
Aviva Gilbert, Co-Chair – Farella Braun + Martel; White Collar Defense & Internal Corporate Investigations Practice

Panelists:
Cathleen Anderson, General Counsel – CrowdStrike

William Keane, Partner – Farella Braun + Martel; Fellow, American College of Trial Lawyers, including White Paper Editor
