District Court Upholds Oregon’s Packaging EPR Law

On August 27, 2026, the Oregon District Court upheld Oregon’s Plastic Pollution and Recycling Modernization Act, which is Oregon's extended producer responsibility (EPR) law applicable to packaging, printing and writing paper, and food serviceware.  

The court had previously issued a preliminary injunction under the Ninth Circuit’s serious-questions standard but, per its August 27 decision, “the Court concludes that Oregon’s Plastic Pollution and Recycling Modernization Act does not violate either the dormant Commerce Clause or the Due Process Clause of the United States Constitution.”  The court had already dismissed plaintiff’s other claims on February 6, 2026.
