Federal Court Enjoins the California AG from Enforcing Prop 65 Warnings for DEA in Cosmetic and Personal Care Products
On June 24, 2026, a California federal court permanently enjoined the California Attorney General (AG), and those acting in privity or concert with the AG, from filing or prosecuting new lawsuits to enforce Prop 65 warning requirements for diethanolamine (DEA) in cosmetic and personal care products.
The court found that enforcement of Prop 65 warnings for DEA in cosmetic and personal care products is inconsistent with the First Amendment, given the current state of the relevant science. The court also specified that the AG may move to dissolve the injunction if there is a change in the facts or law justifying such dissolution.
