Consumer-facing companies, particularly as they become larger and more successful, often receive demand letters from plaintiffs’ attorneys threatening a class action.  Understanding how to approach these claims can weed out the nuisance claims from the real threats. This presentation explores how best to approach these demands, evaluate exposure, determine when and how to change labeling, marketing or other practices, and where appropriate, seek early resolution before a class action is filed. In addition, we will discuss how a company’s own liability insurance may pay for the costs of defending and settling class actions.
