CalRecycle Notices 15-Day Public Comment Period for Revised SB 54 Regulations

On January 29, 2026, CalRecycle gave notice of a 15-day public comment period for the revised regulations to implement SB 54. The public comment period will run from January 29 to February 13, 2026.

As a reminder, SB 54 is California’s extended producer responsibility (EPR) law for packaging, officially known as the Plastic Pollution Prevention and Packaging Producer Responsibility Act. 

As it indicated when it withdrew the proposed regulations on January 9, CalRecycle has revised the proposed regulations applicable to food and agricultural commodities. Among other things, the proposed exclusion for packaging used by a food or agricultural commodity now refers to consideration of “mandatory” regulations, rules, or guidelines issued by USDA, FDA, or that are otherwise applicable; and has otherwise been amended to provide more specificity on the notification procedures for an entity claiming the exclusion and the public disclosure of such notifications.
