Workplace Investigator in the Hot Seat: Issues of Privilege and Impartiality
Kevin Jones is a panelist for the "Workplace Investigator in the Hot Seat: Issues of Privilege and Impartiality" session at the ABA Employment Rights and Responsibilities Committee Midwinter Meeting and National Symposium on Technology in Labor and Employment Law.
Overview:
This panel will consist of role-playing, with an investigator being cross-examined and rehabilitated during a binding arbitration of an investigation. It will focus on key challenges to investigators, including preparation, technique and neutrality, since they are paid by the employer and under the attorney-client, work-product privileges, and discovery requests. The fact pattern of the investigation will raise other issues, such as mental disability or insubordination, as well.
