On August 22, 2025, CalRecycle's Notice of Proposed Action was published, and CalRecycle now has one year to finalize and submit its proposed regulations implementing SB 54 to the California Office of Administrative Law (OAL).

The draft regulations at issue implement SB 54, which is California’s extended producer responsibility (EPR) law applicable to single-use packaging and plastic single-use food service ware. In 2024, CalRecycle held three public comment periods on proposed regulations to implement SB 54. However, in March 2025, before the regulations were finalized, Governor Newsom directed CalRecycle to restart the rulemaking process to ensure that SB 54 is implemented fairly.

The public comment period on these proposed regulations closes on October 7, 2025, and CalRecycle will also be hosting a hybrid public hearing on the proposed regulations on October 7, 2025.
